{"id":982,"date":"2025-06-21T14:02:47","date_gmt":"2025-06-21T12:02:47","guid":{"rendered":"https:\/\/exdigit.plus.ac.at\/?p=982"},"modified":"2025-07-07T10:05:56","modified_gmt":"2025-07-07T08:05:56","slug":"paper-cpdp-2025","status":"publish","type":"post","link":"https:\/\/exdigit.plus.ac.at\/en\/paper-cpdp-2025\/","title":{"rendered":"Paper presentation at CPDP 2025"},"content":{"rendered":"<p>Our paper \u201cTransitioning from Portability in the GDPR to Access in the Data Act: A Multidisciplinary Analysis of Data Access by Design\u201d, co-authored by Emanuella Podda (University of Milano), Nicola Leschke (<a href=\"https:\/\/exdigit.plus.ac.at\/en\/projekte\/exdigit-team\/\" target=\"_blank\" rel=\"noopener\">University of Salzburg<\/a>), Pierangela Samarati (University of Milano), and Frank Pallas (<a href=\"https:\/\/exdigit.plus.ac.at\/en\/projekte\/exdigit-team\/\" target=\"_blank\" rel=\"noopener\">University of Salzburg<\/a>), was accepted and presented at Computers, Privacy, and Data Protection (<a href=\"https:\/\/www.cpdpconferences.org\/\" target=\"_blank\" rel=\"noopener\">CPDP<\/a>) 2025.<\/p>\n<p><strong>A New Access Paradigm<\/strong><\/p>\n<p>The paper is the first multidisciplinary work that looks at the data access and shareability obligations in the forthcoming Data Act and compares them to the established access and portability obligations in the GDPR. We conclude that the Data Act not only goes beyond the dichotomy of personal and non-personal data, but also introduces a fundamental paradigm shift towards <em>continuous, real-time data access by design<\/em>. Thereby, known shortcomings of the respective GDPR rights are addressed and data re-use shall be facilitated.<\/p>\n<p><strong>Technical Implications<\/strong><\/p>\n<p>Based on the new access paradigm, our paper discusses technical implications of the forthcoming Data Act. In particular, the following three changes are expected:<\/p>\n<ul>\n<li>the communication pattern changes from occasional pickups to continuous data flow<\/li>\n<li>the interface changes from static web-forms to automated APIs<\/li>\n<li>the data holder\u2019s internal processes change from ad-hoc excavation to automated retrieval<\/li>\n<\/ul>\n<p>The paper discusses technical solutions and challenges to implement the changes.<\/p>\n<p><strong>The Conference<\/strong><\/p>\n<p>CPDP is a yearly conference in Brussels that connects academia, practitioners, and policy makers to discuss current developments in data protection law and the EU\u2019s digital strategy.
